These are some commonly asked questions:

I’ve seen my own doctor, why do I need to see another medical expert?

The aim of the medical report is to provide an independent medical assessment to the court to support your claim for personal injury compensation (your case will most likely be settled on the basis of the medical report alone, before your case reaches court). The expert will have specialist knowledge of the type of injuries you have suffered and be experienced in providing medical evidence. The medical expert needs to be independent and able to provide an unbiased opinion and therefore needs to be unconnected with the person making the claim.

My injuries are much better now, why wasn’t the medical arranged sooner?

One of the areas that the expert will be asked to comment on in his or her opinion will be the long-term effect of your injuries. For this to be assessed properly, your solicitor may not obtain a medical report for up to six months (or longer) after your accident, so your recovery can be monitored and any lasting or permanent pain, disability or inability to work can be properly recorded.
In order to get a clear understanding of the extent of your injuries, the expert preparing the medical report may need to have access to medical notes from your GP and any other doctors that have treated you, such as an accident and emergency consultant in the hospital. It will also help if you have kept a diary of your injuries and the progress of your recovery.

What will the medical examination involve?

To help the medical expert understand how you have been affected by your injuries you will be asked about the circumstances of your accident and the treatment you have received for your injuries; if you have had to take time off work and how your injuries have affected your day to day life; details of how you are recovering; this is why a diary is helpful detailing the level of pain and discomfort and how you feel now and if you are still suffering any effects from your accident (you should give the expert a copy of your diary when you attend your appointment. The medical examination is for assessment only and no treatment will be given and the doctor will not be able to provide details of how much compensation you will receive so it best not to ask this question.

How long will the appointment take?

The examination time varies by the type of consultant and the nature of your injuries and can take as little as 10-15 minutes or as long as an hour in some cases. The experts are very experienced and may have seen many cases just like yours and will therefore be able to make his assessment very quickly.

Can I take along a friend or relative?

You are very welcome to take a friend or relative along with you.

Will I need to undress?

Our medical expert may wish to give you a brief physical examination and depending on the nature of your injuries you may be asked to remove or loosen some of your clothing.

Who will pay for my transport?

Your travelling expenses to and from the medical examination may be able to be recovered by your solicitor from the party who was responsible for your injuries, if your claim is successful. You should keep all receipts for parking, train, bus or taxi fares and forward them to your solicitor.

What if I have to take time off work?

If your employer will not pay you for taking time off work to attend the medical examination, your solicitor may be able to recover these loss of earnings from the party who was responsible for your injuries.
